Mahendru PC Secures $1.7M Summary Judgment Against Personal Injury Law Firm Over Unpaid Loans 

Mahendru PC’s trial lawyers have secured a $1.7 million judgment on behalf of a Houston-based litigation finance firm in a suit against a personal injury law firm for unpaid loans.

According to the lawsuit, the New Jersey-based Vlasac & Shmaruk Law Firm borrowed nearly $1 million from Series 4 – Virage Master LP to assist in prosecuting cases. Vlasac & Shmaruk agreed to repay the loan by turning over at least 60 percent of the fees and expenses it earned from certain cases.

In its motion for summary judgment, Mahendru PC successfully argued that although Vlasac & Shmaruk began receiving proceeds from many cases, it violated the terms of the loan agreement by failing to repay the money to Virage.   In issuing the final judgment, Judge Alfred H. Bennett, of the Federal District Court for the Southern District of Texas, awarded Virage $1.7 million in damages.

The case is Series 4 – Virage Master LP v Vlasac & Shmaruk LLP, Civil Action No. 4:19-cv-04537, in the U.S. District Court for the Southern District of Texas, Houston Division.
