A Montgomery County judge has issued a final judgment confirming a $3.3 million arbitration award for a north Houston medical group after Mahendru PC successfully argued that several of its former physicians failed to properly complete and terminate their employment agreements before opening a competing practice.
Genesis Medical Group CEO and founder Dr. David P. Ellent initiated arbitration against Woodland Diagnostic Clinic P.A. to recover damages after a group of doctors left Genesis to form a competing clinic less than a block away, which was in direct violation of their Employment Agreements and Asset Purchase Agreements.
Following the arbitration hearing, Genesis Medical Group was awarded $3.3 million in damages, which the defendants attempted to vacate. The defendants’ motion to vacate the arbitral award was denied, confirming the award secured by Mahendru PC.
The case is David P. Ellent, P.L.L.C., d/b/a Genesis Medical Group v.
